Woman sues debt collector for calling her cell phone

PHILADELPHIA - A consumer filed a lawsuit against a debt collection company alleging breach of fair practice law in 2014.

Tameka Parker of Upper Darby sued CBE Group of Cedar Falls, Iowa in the U.S. District Court Eastern District of Pennsylvania on June 25, alleging violation of the Fair Debt Collection Practices Act in its attempts to contact her from July through December 2014.

According to the filing, the business repeatedly contacted the plaintiff on her cellphone in an effort to collect a consumer debt alleged to be incurred for personal, family or household purposes.

Parker argues that she is charged a fee for every call received on her cellular device. Claiming that the defendant called multiple times every week, and that she did not provide CBE with her cellphone number, Parker maintains that the firm is in breach of fair practice.

Additionally, she asserts that the company failed to send her written correspondence to notify her of her right to dispute the debt claim or request verification of the amount and the identity of the original creditor.

Claiming annoyance and inconvenience, the plaintiff seeks actual and statutory damages, attorneys’ and witnesses’ fees, and court costs. She is represented by Craig Thor Kimmel of Kimmel, Kimmel & Silverman in Ambler.
