Improper venue alleged in negligence lawsuit against Parx Casino

PHILADELPHIA – Attorneys for Parx Casino in Bensalem are seeking to transfer a negligence lawsuit filed against it in March to Bucks County, on the basis of improper venue.

Andrew J. Kramer of Kane Pugh Knoell Troy & Kramer, in Norristown, filed a motion for preliminary objections on April 2 in the Philadelphia County Court of Common Pleas, charging the litigation initiated by Philadelphia resident Alicia Griffin should have been filed in the Bucks County Court of Common Pleas instead.

Kramer’s motion explained the subject incident of the litigation occurred in Bucks County, Parx Casino itself is located in Bucks County and the casino itself does not do any business in Philadelphia County.

A hearing in this matter was scheduled for Wednesday at Philadelphia City Hall, in Court chambers.

Griffin initiated her litigation against Greenwood Racing (the parent name of Parx Casino), Bensalem Racing Association and Keystone Turf Club in March, in connection with a fall she sustained at Parx Casino on Jan. 5, 2014.

Griffin was on the premises and fell on snow and ice, on the casino’s entrance walkway – and maintained it was the casino’s negligence in failing to maintain the premises, clear the premises, block off the hazardous area or warn customers of the potential hazard, in addition to non-compliance with lawful building codes.

Griffin allegedly suffered permanent injuries in the fall, including impairment of bodily function, lumbar disc protrusions, bilateral knee strains and sprains, lumbar sprains and strains, and other injuries.

The plaintiff is seeking judgment in excess of $50,000, plus all reasonable costs and other relief against all defendants.

The plaintiff is represented by Marc F. Greenfield, of Spear Greenfield & Richman, in Philadelphia.

The defendant is represented by Kramer of Kane Pugh Knoell Troy & Kramer, in Norristown.
