Propane company sues insurance company over unpaid claim

Courthouse pittsburgh

A Columbia County business is suing its insurance company over an unpaid claim.

Representatives from Heller’s Gas filed a lawsuit July 7 in U.S. District Court for the Middle District of Pennsylvania against International Insurance Company of Hannover for breach of contract.

According to the filing, representatives from Heller’s Gas made a timely claim concerning property loss caused by a sinkhole under the company’s propane tanks. The insurance company, however, denied the claim, stating it was excluded from the policy. The filing states that the defendant failed to retain experts or perform a proper investigation of the property damage.

The plaintiff seeks a judgment in its favor for damages of more than $75,000 plus attorney’s fees and court costs. Heller’s Gas is represented by Theodore Adler of the Reager and Adler Law Firm.

U.S. District Court for the Middle District of Pennsylvania case number 4:15-cv-01350-MWB.
