Injured employee alleges wrongful termination

A former Pennsylvania resident currently living in Maryland is suing her former Centre County employer, alleging retaliatory disability discrimination and Family and Medical Leave Act violations in her dismissal.

Tracy A. Reagan, formerly of Blanchard, filed a lawsuit July 16 against Centre Lifelink Emergency Medical Services of State College, in U.S. District Court Middle District of Pennsylvania, alleging infringement of employment law in 2013.

According to the complaint, Reagan was terminated from employment by the defendant while she was on approved FMLA leave. The suit states while vacationing June 9, 2013, the plaintiff suffered a traumatic brain injury and a dislocated hip in an accident and was granted leave June 12-July 29, 2013.

The suit says Reagan received a communication July 10, 2013, from her employer’s attorney regarding company business. The lawsuit alleges Reagan emailed indicating she would be retaining an attorney of her own to respond and Reagan was terminated via certified mail July 23, 2013, for her “failure to respond” adequately.

The plaintiff charges her former employer with willful violation of her rights and alleges lost back and front pay and benefits, medical insurance and future job opportunities.

Regan seeks compensatory damages, pre- and post-judgment interest, attorney fees and court costs. She is represented by attorney Amy Marshall of Babst, Calland, Clements and Zomnir in State College.
