PHILADELPHIA - A couple is suing Amtrak over a train accident that resulted in injuries.
Catherine and Christopher Trapani filed a lawsuit July 24 in U.S. District Court for the Eastern District of Pennsylvania against National Railroad Passenger Corp., doing business as Amtrak, citing negligence.
According to the filing, Catherine Trapani was a passenger on May 12 when the train derailed as it approached Frankford Junction in Philadelphia.
The filing states that the speed of the train was reckless and excessive and caused passenger cars to be mangled and flipped upside down.
According to the filing, the plaintiff was violently thrown, lost consciousness and was pinned inside the wreckage for at least an hour. Her injuries included internal bleeding, a concussion, broken bones, liver damage, muscle tearing and contusions.
The couple are seeking a judgment in their favor and compensatory and punitive damages, as well as attorney’s fees and court costs. They are represented by Carol Schuler and Charles Montgomery of the EARP Cohn Law Firm in Philadelphia.
