Beer brewery battles insurer, federal agencies to recoup flood damages

A beverage brewing business is suing federal government agencies alleging noncompliance in the aftermath of a 2014 flood which damaged its property in Philadelphia.

Philadelphia Beer Works, also known as Manayunk Brewing Co., sued NFIP-Direct, the U.S. Department of Homeland Security, and the Federal Emergency Management Agency in the U.S. District Court Eastern District of Pennsylvania on July 27, claiming that an April 2014 flood caused property damage for which the company must be compensated.

According to the suit, the plaintiff’s premises, located at 4120 Main St. in Philadelphia, were covered by a flood insurance policy with $500,000 limits. Manayunk Brewing Co. contends that it is owed funds from an unpaid portion of its claims for flood damage occurring on or about April 30, 2014.

Alleging that it had been up to date on its premiums, Manayunk declares that it submitted a claim to the defendant for losses in the amount of $632,712.21, but that they were only reimbursed for $150,000 under the policy. At issue was the fact that part of the property affected was located in a basement, which the defendants allegedly excluded from coverage. The defendants also calculated the losses at $179,058.41, and factoring in depreciation and deductible, paid the plaintiffs an additional $13,947.75, according to the lawsuit.

Manayunk Brewing Co. seeks monetary damages, attorney’s fees and court costs. The company is represented by Thomas T. Booth Jr. of the Law Offices of Thomas T. Booth Jr. of Voorhees, NJ.
