Woman demands jury trial over allegedly unpaid insurance claim

A Monroe County woman has filed a lawsuit and is demanding a jury trial alleging that a Michigan-based insurance company has yet to pay out a claim.

Beata Rogowski, also known as Beata Walkosz, filed a lawsuit Aug. 17 in the U.S. District Court for the Middle District of Pennsylvania against Foremost Insurance Co., located in Grand Rapids, over a claim that the insurance company has failed to honor its obligation under the policy she signed with the company.

According to the complaint, on or about Aug. 17, 2013, Rogowski’s home at 4145 Fox Chase Terrace was damaged by a house fire and she eventually submitted a claim to the Foremost Insurance Co.

According to the lawsuit, Rogowski maintained the policy in good standing, making any and all payments due. She said she has suffered and will continue to suffer direct and consequential damages as a result of the insurance company not honoring its policy, the lawsuit states. She is seeking damages of more than $75,000 plus court costs, interest and attorney's fees.

Rogowski is being represented by Salvatore P.J. Vito of Stroudsburg.
