A Maine man is suing the makers of Tylenol PM, alleging the drug caused acute liver failure.

Melburn Knox, of Lincoln County, Maine, filed a lawsuit Aug. 27 in U.S. District Court Eastern District of Pennsylvania against McNeil-PPC, Inc., McNeil Consumer Healthcare and Johnson & Johnson Inc., alleging negligence.

According to the complaint, Knox ingested the drug from approximately July 1, 2008, to Sept. 13, 2009, and suffered acute liver failure Sept. 14, 2009.

The suit says the defendants are guilty of negligent design defect, breach of implied warrant of fitness for particular purpose, negligent failure to warn, and violation of consumer protection laws.

Knox seeks punitive damages as well as discovery rule and tolling. He is represented by attorneys Christopher A. Seeger and Sindhu S. Daniel of Seeger Weiss in Newark, N.J.
