Reading couple sues CVS Pharmacy, alleging negligence for fall injuries

A Reading couple is suing CVS Pharmacy, alleging negligence in a slip and fall that the plaintiffs say left the husband with irreparable damages.

Stephen Pullano and Michelle Pullano of Reading filed a lawsuit Sept. 10 against CVS Pharmacy Inc. in U.S. District Court Eastern District of Pennsylvania, alleging negligence in Stephen's serious injuries.

According to the complaint, on Sept. 23, 2013, at the CVS Leesport location at 906 W. Leesport Road, as Stephen walked in the store’s main aisle, he slipped and fell on “a dangerous accumulation of soapy water on the tile floor,” sustaining painful, permanent personal injuries.

The suit states CVS was guilty of negligence in allowing the puddle to exist, failing to correct the hazard, neglecting to warn the plaintiff of the condition, and overlooking routine safety inspection.

The plaintiffs blame CVS for Stephen Pullano’s injuries, including a torn rotator cuff, dislocated right shoulder, a knee injury requiring surgical correction, spinal strain and other damage, along with overall shock to his nervous system, the suit says.

The plaintiffs allege pain, anguish, medical bills, limitation of daily activities and duties, lost wages and impaired earning capacity.

The Pullanos seek damages more than $150,000, interest, attorney fees and court costs. They are represented by attorney Richard Kupersmith of Haggerty, Goldberg, Schleifer & Kupersmith in Allentown.
