PHILADELPHIA – Counsel for a car crash plaintiff is withdrawing his appearance over various conflicts with his client.
Marc I. Simon of Simon & Simon in Philadelphia, filed a motion with the Philadelphia County Court of Common Pleas on Aug. 7, citing “irreconcilable differences over course, direction and scope of the litigation” with his client, Shafon Smith of Philadelphia. Simon stated if the Court desired more information, an in-camera discussion would be appropriate, so as not to breach attorney-client privilege.
A hearing in this matter was set for Thursday at Philadelphia City Hall, in Court chambers. The November lawsuit filed by Smith is in connection with a motor vehicle accident that had transpired one year earlier.
The suit alleged on Nov. 16, 2013, Smith was a passenger in a vehicle driven by Khalid Raheem and owned by H. Kulp, Inc., both of Gilbertsville. The vehicle was traveling near Chestnut and Salford Streets in Philadelphia, when Raheem’s allegedly negligent driving caused an accident.
Smith claimed to suffer “serious and permanent personal injuries, bodily function impairment, serious disfigurement and aggravation of certain injuries”, and incurred expenses in excess of the Pennsylvania Motor Vehicle Financial Responsibility Law (PMVFRL).
Smith’s suit levies counts of negligence against Raheem, plus negligent entrustment and the respondeat superior theory of liability against H. Kulp.
The plaintiff is seeking a sum in excess of $50,000, plus costs and other relief.
The defendants are represented by J. Vincent Roche and Brooke Hanley, of Margolis Edelstein in Philadelphia.
