Customer sues Target alleging negligence in Springfield branch slip and fall

A Delaware County man is suing a large, well-known retail corporation on charges of premises liability, alleging negligence in a slip and fall accident in the defendant’s store in Pennsylvania.

James Stern of Glenolden sued Target Corp. of Minneapolis, Minn. in the U.S. District Court Eastern District of Pennsylvania on Oct. 8, claiming premises liability in a December 2014 personal injury which the plaintiff claims to have sustained at the retailer’s Springfield location.

According to the complaint, Stern was working in the back warehouse at the Target store located at 857 Baltimore Pike on or about Dec. 23, 2014, when he suddenly “slipped on a wet substance that had accumulated on the floor, thereby causing him to fall and sustain various severe and permanent bodily injuries and losses….”

The plaintiff charges the defendant with carelessly and negligently allowing the substance to exist on the floor for a prolonged period of time, failing to inspect the premises and identify the hazard to prevent injury to patrons, warn customers of the danger, and clean up the substance.

The suit states that Stern suffered spinal injuries, including aggravation of existing degenerative disc disease; bruising and swelling, pain, anxiety and anguish, and nervous shock. The plaintiff claims lost wages and earning potential along with medical expenses.

Stern seeks monetary damages of more than $150,000, interest, attorneys’ fees, and court costs. The plaintiff is represented by Brandon Swartz and Scott Diamond of Swartz Culleton in Newtown.
