Injured customer sues Wal-Mart over fallen grapes

A Dauphin County woman is suing a large U.S. retail company on charges of premises negligence regarding a slip-and-fall accident in one of its Pennsylvania outlets which allegedly resulted in broken bones.

Hana Abraham of Harrisburg sued Wal-Mart Stores East LP of Bentonville, Ark., in the U.S. District Court for the Middle District of Pennsylvania on Oct. 9, claiming negligence in June 2015 at the company’s 6535 Grayson Road, Harrisburg, location.

According to the complaint, Abraham was a customer at store No. 1591 on or about June 9, traveling through the produce department, when she slipped and fell on grapes and/or other items which had been allowed to remain on the floor’s surface.

The suit states that the plaintiff struck her left arm, wrist and elbow on the floor, incurring significant pain, and later learned that her arm had been broken.

Alleging that Wal-Mart allowed the hazard to exist, failed to remove the scattered items, warn the plaintiff and the general public of the debris, inspect the area, and provide barricades or warning signage, Abraham claims serious physical disabilities and impairments as a result of the incident, citing medical expenses, limitations in everyday functioning, decreased ability to enjoy life, and loss of earnings.

Additionally claiming trauma, anguish and humiliation, the plaintiff seeks monetary damages of more than $75,000, interest, attorneys’ fees, and court costs. She is represented by Derrek Cummings and Larry Weisberg of McCarthy Weisberg Cummings in Harrisburg.
