A Salamanca, N.Y. man is suing a railroad company he worked for over cumulative injuries he sustained over his years on the job.
John Haley filed a complaint Sept. 30 in the U.S. District Court for the Western District of Pennsylvania against Buffalo & Pittsburgh Railroad, alleging negligence.
The complaint states Haley has worked for Buffalo & Pittsburgh Railroad since July 1988, during which time he was exposed to physically stressful, ergonomically awkward job duties, including walking and working on improper walking surfaces.
The complaint states these duties have caused cumulative trauma or repetitive stress injury affecting Haley's musculoskeletal system, including his lower extremities such as his hip and ankles.
The complaint further states these injuries were caused by the defendant's negligence in failing to provide a reasonably safe place to work, failing to provide reasonably safe conditions for and methods of work, failing to enact and follow an ergonomics program, and other negligent acts or omissions.
As a result, Haley has sustained physical pain and mental anguish, lost wages and income, and medical expenses. Haley seeks a judgment of more than $75,000, plus costs of the suit. He is represented by Todd R. Brown of Malone Middleman in Wexford.
