Pittsburgh resident sues Benton Energy Service to claim alleged unpaid overtime wages

A Pittsburgh resident, who claims he has worked 12 hours day, seven days a week for at least two years, is suing an oilfield service company claiming unpaid overtime wages.

Mickey J. Bergeron, as a part of a class and collective action complaint, filed a lawsuit against Benton Energy Service Co. on Aug. 3 in the U.S. District Court for the Western District of Pennsylvania, Pittsburgh Division citing a violation of the Pennsylvania Minimum Wage Act and the Fair Labor Standards Act.

According to the complaint, during his employment between 2012 and 2014, Bergeron and other employees often worked 12 hours a day, seven days week – working in excess of 84 hours a week without overtime pay. During his last few months of employment, Benton, the claim states, changed its pay practices and began paying all employees hourly.

Bergeron, who is seeking unpaid wages, liquidated damages, and/or penalty damages, is being represented by Pittsburgh-based attorney Joshua P. Geist of Goodrich & Geist and Houston-based attorneys Michael A. Josephson, Andrew Dunlap, Lindsay R. Itkin and Jessica M. Bresler of Fibich, Leebron, Copeland, Briggs & Josephson.
