Plaintiff attorney looking for settlement for incapacitated client

PHILADELPHIA – Plaintiff counsel is looking for the defendants in a motor vehicle accident negligence case to settle with his incapacitated client.

Marc F. Greenfield filed a motion to that effect on Dec. 29, recognizing that a settlement of $16,000 had been completed in the instant action on behalf of Philadelphia plaintiff Johnny Clarkson and his parent/natural guardian, Denise Sheared. 

Greenfield explained Clarkson would be due to receive a net total of $6,817.95, after resolving the following financial obligations associated with the case:

- Counsel Costs: $4,908.12;

- Firm Costs: $1,275.67;

- Roosevelt Family Center: $1,500.00;

- Keystone Diagnostics: $150.00;

- Freedom Medical: $1,300.00; and

- Commonwealth of Pennsylvania – DPW: $48.26

A hearing in this matter was set for Tuesday at Philadelphia City Hall, in Court chambers.

On Jan. 16, 2012, the plaintiff was a passenger in a vehicle operated by defendant Maurice Shaw, and owned by fellow defendants Penske Truck Leasing and the Share Food Program. At the same time, defendant Fahiym Husaam Al Nichols operated a vehicle owned by defendant Ann Swain-Clark at the same location, Roberts Avenue between Wissahickon Avenue and Deacon Street.

Allegedly, both Shaw and Nichols negligently and carelessly operated their vehicles, leading to a collision which seriously injured Clarkson.

The suit contains personal injury counts against all defendants, and one joint and several count against the defendants. The plaintiffs also seek recovery for medical benefits in excess of the permitted recoverable amount under the Pennsylvania Motor Vehicle Financial Responsibility Law (PMVFRL), and Workers Compensation benefits.

The plaintiffs are seeking a sum not in excess of $50,000, plus attorney’s fees, costs and other relief in this case. If the arbitration hearing is appealed, then a jury trial is demanded for damages in excess of $50,000.

The plaintiffs are represented by Marc F. Greenfield of Spear Greenfield & Richman, in Philadelphia.

The defendants are represented by John I. Gordon in Lafayette Hill, Jacqueline E. Campbell, Robert P. Corbin of German Gallagher & Murtagh and Kevin W. Lynch of Connor Weber & Oberlies, all in Philadelphia.
