Nurse alleges Pottstown Hospital unlawfully terminated her

Nursing

PHILADELPHIA — A registered nurse alleges that she was unlawfully terminated by a Pottstown hospital because she frequently took time off work because of her Crohn's Disease, fibromyalgia and thyroid cancer.

Sara Fullerton filed suit in the U.S. District Court for the Eastern District of Pennsylvania on Sept. 28, alleging that Pottstown Hospital violated the Family Medical Leave Act, the Americans With Disabilities Act and the Pennsylvania Human Relations Act when it terminated her following her return from medical leave.

Fullerton alleges that despite her illnesses she is able to perform her duties, but requires some accommodations to her workload. After returning from time off due to her medical issues in November 2014, the plaintiff alleges she was unlawfully terminated.

She is demanding unspecified past and future wages, plus liquidated damages, punitive damages and attorney fees. Fullerton is represented by Ari R. Karpf of Karpf, Karpf & Cerutti, PC in Bensalem, Pennsylvania.
