Produce business sues Jerilu Fruit, alleging failure to pay $50,000

A produce company is suing an Erie distributor, alleging the plaintiff is owed more than $50,000.

Brigiotta's Farmland Produce & Garden Center Inc., based in Jamestown, N.Y., filed a lawsuit Oct. 15 in U.S. District Court Western District of Pennsylvania against Jerilu Fruit and Produce Company, Matthew S. Eincher, Deborah Constable and Robert Catalde, alleging they failed to pay for thousands of dollars of produce purchased from the center.

According to the complaint, Brigiotta's entered into an agreement to supply produce and a set price that would be paid back by Jerilu. The suit says Brigiotta's invoices for payments were either left unanswered or answered with checks written from accounts with insufficient funds.

The plaintiff says it is owed $50,619.26

Brigiotta's Farmland Produce and Garden Center seeks the overdue payment, plus further interest, attorney fees and court costs, as well as any other relief the court deems necessary.
