Woman joins Tylenol litigation alleging acute liver failure

An Ohio woman filed suit in a pending Tylenol litigation alleging the drug caused acute liver failure.

Kia Smith filed suit against McNeil-PPC Inc., Johnson and Johnson Inc. and McNeil Consumer Healthcare in the Tylenol litigation pending in the U.S. District Court for the Eastern District of Pennsylvania, master complaint no. 2436.

The plaintiff alleges she suffered acute liver failure on Nov. 21, 2013, as a result of consuming Extra Strength Tylenol products. The lawsuit alleges the defendants breached an implied warranty of merchant-ability, negligent failure to warn, negligent design defects and other causes of action.

The plaintiff is seeking unspecified damages. She is represented by R. Clay Milling, Harvey R. Spiegel and Marla M. Eastwood of Henry, Spiegel, Milling LLP, of Atlanta, Georgia.
