Woman claims driver's negligence caused her serious injuries in Pittston accident

A Kingston woman claims a driver's negligence caused her serious injuries and is suing the driver and his employer.

Melissa Kyzer filed a lawsuit on Nov. 13 in U.S. District Court for the Eastern District of Pennsylvania against Dewar Nurseries Inc. of Apopka, Florida and its driver, David Williams, claiming she was injured in an accident caused by Williams' negligence.

Kyzer claims on Nov. 21, 2014, while at the intersection of Centerpoint Boulevard and Armstrong Road in Pittston, she was struck by a vehicle owned by Dewar and operated by Williams. Kyzer claims Williams was at fault by making an improper left turn and therefore caused the accident. Kyzer claims the accident led to injuries in her shoulder which required surgery, as well as neck pain, muscle aches, tenderness, headaches and depression. 

Kyzer is seeking an excess of the amount of $75,000 from each defendant, together with delay damages, interests, the costs of this actions, and other relief the court sees fit. Kyzer is represented by Jonathan S. Comitz and Kristopher J. Januzzi in Wilkes-Barre.
