PHILADELPHIA – Two companies are suing an Ohio business over claims of patent infringement for a ceiling system.
Armstrong World Industries, Inc and AWI Licensing Co., Inc., filed a lawsuit on Nov. 11 in U.S. District for the Eastern District of Pennsylvania against Norton Industries, Inc. for patent infringement.
According to the complaint, AWI Licensing was awarded a ceiling system patent on July 28, and are holders of the exclusive license of the patent and design. Armstrong has the exclusive license to use and practice the patent. The companies claim that Norton has a system that illegally infringes on that patent, and that the infringement is in direct violation of law and is damaging to the product and companies.
The companies are seeking an injunction to stop Norton from using the patent, reasonable royalty for the use of the patented system, compensation for Norton's acts of infringement, pre-judgment and post-judgment interest, and any further relief the court sees fit. They are represented by Thomas T. Loder of Philadelphia, and Matthew C. Gaudet and John R. Gibson of Atlanta.
