An Oregon wine manufacturer is suing for damages of trademark infringement.
Naked Wines LLC, filed a lawsuit Nov. 2 in U.S. District Court for the Eastern District of Pennsylvania against BREW4YOU, doing busines as Prism Brewing Co., claiming trademark infringement, false designation of origin and unfair competition.
Naked Wines, an Oregon-based company, claims they've produced and manufactured "naked wine" since 2009 and held the trademark rights for "NKD" wines since July 9, 2014. The company claims BREW4YOU began marketing "naked" brews and malts in 2013, a direct violation of their trademark. Naked Wines claims BREW4YOU has damaged its product and royalties.
Naked Wines is seeking an injunction disallowing BREW4YOU to use "naked" wording, pictures or symbols, as well as actual and punitive damages based on BREW4YOU profits, pre-judgment and post-judgment interest, costs and attorneys' fees, and other other relief the court sees fit.
