Family sues Monroe County over injury claims after child was injured by dog

SCRANTON – A minor and her parents are suing a Monroe County man for injuries allegedly suffered by the child when the man’s attacked and bit her on the face.

Giavanna T. Rose, as a minor, Michael Rose and Jennifer Rose, all of Avon, Ohio, filed a lawsuit against Joseph DiCandia of Henryville on Nov. 5 in the U.S. District Court for the Middle District of Pennsylvania, citing negligence.

On or about Dec. 7, 2014, DiCandia’s dog, without provocation, according to the lawsuit, attacked Giavanna and bit her on the face, causing her to suffer a puncture wound to the chin and lower jaw as well as a facial laceration on her right cheek. The Rose family believes the injuries are permanent and expect to incur future medical expenses in the indefinite future.

The plaintiffs charge DiCandia with failure to restrain the dog, warn others, take precautions and exercise reasonable control of the dog.

The child, through her parents, are seeking in an amount of more than $75,000 plus all costs and other relief the court may deem necessary.
