PHILADELPHIA – A former mechanical assembler at a Bucks County optic company is suing the business claiming he was treated unfairly due to his medical condition while at work and that he was fired during the course of his treatment for a head and brain injury.
Jeffrey Cybok filed a lawsuit against Fraser Volpe Corp. and Fraser Optics LLC on Nov. 4 in the U.S. District Court for the Eastern District of Pennsylvania citing violations of the Americans with Disabilities Act, the Pennsylvania Human Relations Act and the Family Medical Leave Act.
After being hired by Fraser in June 2012, Cybok said he suffered a brain injury in February 2013 and was later diagnosed with post-traumatic stress disorder and depression. The conditions led him to take several days off for treatment, according to the complaint. In or about May/June 2013, a new supervisor, Cybok claims, began to treat him in a hostile manner. Also, he was given a good performance review in December 2013 in every category except dependability.
On June 5, 2014, Cybok claims he sent a letter to the company’s human resources department stating that his new supervisor was treating him unfairly based on his medical condition. On Nov. 7, 2014, he was fired. The complaint states he was wrongfully terminated because of his medical conditions and in retaliation for reporting the discriminatory behavior of his supervisor.
Cybok seeks compensation and reimbursement, punitive and liquidated damages and costs of suit. He is represented by based attorney Ari K. Karpf of Karpf, Karpf and Cerutti, P.C. in Bensalem.
