Auto accident defendants looking for transfer to Delaware County

PHILADELPHIA – Counsel for defendants involved in a serious automobile accident in Delaware County are seeking the case to be transferred to that venue.

Defense attorney Pamela B. Hinton filed a motion for preliminary objections on Aug. 12, maintaining the accident took place in Delaware County and therefore, that is the only proper venue for the case, in addition to the defendants having no connection to Philadelphia County.

A hearing in this matter was set for Wednesday in Court chambers, at Philadelphia City Hall.

On May 16, 2013, Winston Morgan was traveling southbound on Baltimore Pike near its intersection with Pennell Road in Middleton Township and stopped at a red light, when a vehicle driven by Helen Colli rear-ended Morgan’s car, the lawsuit says. Morgan alleged Colli’s negligent and careless driving caused the accident.

Morgan sustained cervical strain leading to severe neck pain, lumbar sprain, pain associated with disc bulges and protrusions and other injuries, including mental and physical traumatic anxiety reaction.

In May, Morgan filed suit against Colli for negligence in failing to keep a proper lookout and maintain a proper distance, in addition to a count of negligent entrustment against her husband, Jerry Colli.

The plaintiff is seeking judgment in excess of $50,000, plus costs and other relief in this case.

The plaintiff is represented by Brian S. Chacker of Gay Chacker & Mittin, in Philadelphia.

The defendants are represented by Hinton, and Simona Polyakov Shipp of the Law Offices of Sue Ann Eckell, both in Philadelphia.
