PITTSBURGH – A man has filed a class-action lawsuit against his employer over allegedly withholding overtime pay.
Kenneth Courville Jr. filed a complaint Nov. 3 in the U.S. District Court for the Western District of Pennsylvania against DWM Consulting LLC, alleging violation of the Pennsylvania Minimum Wage Act and similar laws in Ohio, North Dakota and New Mexico.
Courville and numerous co-workers were employed by the defendant during the years of 2013 and 2014. During his time as a solids control officer, the plaintiff claims he often worked 12-hour shifts for seven days a week, but because he was improperly classified as an independent contractor he was paid a day rate, never receiving overtime pay. Courville purports that the defendant was in violation of various labor laws since they denied overtime pay for all hours worked above 40 per week.
Courville and his colleagues are seeking compensation for all lost wages, back pay and legal fees. Courville is represented by Joshua P. Geist of Goodrich and Geist P.C., in Pittsburgh.
