Route driver for Utz Quality Foods sues over unpaid overtime claims

CINCINNATI – The nation’s largest independent, privately held distributor of snack foods is being sued over a complaint by one of its route drivers for alleging not paying overtime rates.

Brian Jurden filed a lawsuit on Sept. 15 in the U.S. District Court for the Southern District of Ohio Eastern Division, against Utz Quality Foods Inc., with its principal place of business in Hanover, Pennsylvania, citing a complaint for violations of the Fair Labor Standards Act.

Jurden claims that he and other route drivers did not receive overtime pay for hours worked more than 40 hours per work week during the last three years.

Jurden, on behalf of other route drivers, is seeking unpaid wages including overtime wages as to be determined at trial together with any liquidated damages allowed by law.

Jurden is being represented by Hans A. Nilges of Nilges Draher, LLC in Canton, Ohio and Anthony J. Lazzaro of the Lazzaro Law Firm LLC in Cleveland.
