Mother sues Pfizer alleging that defects in Zoloft harmed her infant

PHILADELPHIA – A mother is suing a pharmaceutical company after delivering a child with birth defects, which she claims are a fault of taking certain drugs while pregnant.

Cheryl Phillips filed a complaint Aug. 31 in the U.S. District Court for the Eastern District of Pennsylvania against Pfizer Inc. and J.B. Roerig & Co., citing defective products, failure to warn, negligence, fraud and other counts.

During her pregnancy, the plaintiff was under the prescription of Zoloft, a medication prescribed by her physician, the complaint states. After delivering her daughter, Phillips learned that her child suffered from several birth defects, including a ventricular septal defect, which she claims are a result from taking Zoloft. She is suing the defendant, purporting that it was negligent for the company to fail to warn of the risks associated with Zoloft.

Phillips is seeking compensation of more than $75,000 for all damages suffered. She is represented by Jennifer A. Lenze of Sizemore Law Firm PLC in El Segundo, California. The case has been assigned to Judge Cynthia M. Rufe.
