PHILADELPHIA – A drug distributor is suing one of its suppliers after the supplier allegedly failed to fulfill contractual agreements.
AmerisourceBergen Drug Corp. and Bellco Drug Corp. filed a complaint Aug. 28 in the U.S. District Court for the Eastern District of Pennsylvania against Vansen Pharma Inc., Pharma Romlev Inc. and Romlev Pharma Inc., citing breach of contract.
The plantiffs and the defendants had a contractual agreement that involved the purchasing and sales of drugs, with the agreement outlining that Vansen would sell products to AmerisourceBergen. In the contract, details allowed for AmerisourceBergen to return drugs during a period of time, with the understanding that Vansen would receive the products and provide compensation for the return products. The plaintiff is suing the defendant, alleging that Vansen failed to compensate AmerisourceBergen for returned products.
AmerisourceBergen is seeking compensation for returned products, as well as reparation for all damages. It is represented by Maurice R. Mitts of Mitts Law LLC in Philadelphia.
