PHILADELPHIA – JanSport Apparel Corp. is suing a competitor alleging that it is selling almost identical backpacks to what JanSport manufactures.
JanSport Apparel Corp. filed a complaint on Nov. 30 in the U.S. District Court for the Eastern District of Pennsylvania against UNIF LLC alleging unfair use and sale of trademark.
According to the complaint, JanSport is an internationally renowned company, selling backpacks and accessories for many different designs, color and styles. JanSport says it solely has the right to sell and market its specific line of backpacks. UNIF, a competitor of JanSport, has begun to manufacture and sell Badsport backpacks, which resemble JanSport products not only in logo but also in overall design, the complaint states. JanSport is suing UNIF alleging that the designs reflect unauthorized use of federally trademarked products.
Jansport is seeking compensation for all lost profits, legal fees and other damages. The corporation is represented by Paul J. Kennedy and Sean P. McConnell of Pepper Hamilton LLP in Philadelphia.
