Man sues New York Life Insurance, others alleging breach of contract

PHILADEPHIA – A Dresher man is suing his insurance provider alleging a failure to provide disability coverage.

Robert C. Katz filed a complaint on Dec. 9 in the U.S. District Court for the Eastern District of Pennsylvania against New York Life Insurance and Annuity Group, Unum Group Corp. and the Paul Revere Life Insurance Co., citing breach of contract, breach of fiduciary duty, bad faith, fraud and other counts.

According to the complaint, Katz started a disability insurance policy with the defendant in 1985 when he was 27 with the agreement that the coverage would continue until he was 65. Katz has been unable to work since 1999, he says. In 2012, however, he received a notification that his insurance would expire the following year at the age of 55, the complaint states. This was an alleged breach of the original contract, which stated that the insurance would continue on for another 10 years. Despite the original contract and Katz's protests, the defendant allegedly ignored him and denied to provide further options or consultation, the complaint states. Katz is suing for breach of contract, stating that he would have found another company had he known about the issue.

Katz is seeking compensation of more than $75,000, a declaration stating that the policy is in effect plus court costs. He is represented by Jonathan J. Sobel of the Law Offices of Jonathan J. Sobel in Philadelphia.
