Man sues Chipotle Mexican Grill alleging age discrimination

PHILADELPHIA – A Philadelphia man is suing a Mexican restaurant chain alleging that he was discriminated against due to his age.

Eric Hazelwood filed a complaint on Dec. 9 in the U.S. District Court for the Eastern District of Pennsylvania against Chiptole Mexican Grill alleging violation of the Age Discrimination in Employment Act.

According to the complaint, Hazelwood, 52 at the time, applied for a position in the Ardmore facility in 2012 and after submitting his application was interviewed on two different occasions by two different managers. In one of the interviews, the manager allegedly mentioned the plaintiff's age several times, and asked the plaintiff to fill out a new application, claiming that he could not find the original copy. Shortly after this, the plaintiff was informed that he did not receive the position. Hazelwood is suing the company for age discrimination, claiming that the Ardmore Chipotle hired several others around the same time who were younger than 40.

Hazelwood seeks compensation for all lost wage opportunities, as well as all legal fees. He is represented by Samuel A. Dion of Dion and Goldberger in Philadelphia.
