Registered nurse sues Omni Home Care over claims she was terminated for not complying with illegal procedures

SCRANTON – A registered nurse is suing her employer over claims she was terminated for reporting allegedly illegal activity.

Tracey Eaves-Voyles filed a complaint on Dec. 16 in the U.S. District Court for the Middle District of Pennsylvania against Almost Family Inc., doing business as Omni Home Care, alleging retaliation and unlawful termination.

According to the complaint, Voyles was employed as a nurse and clinical manager by Omni Home Care in 2015. On July 2, the plaintiff emailed her supervisor with a work-related concern about certain state regulations that were being violated, such as admitting patients to care by nurses who were not certified to handle their specific conditions. Immediately following her confrontation of the issue, the plaintiff also contacted medical authorities to tell them of the actions. After her reporting of the issue, Voyles claims her employment was terminated the next day. She is suing for the retaliation and unlawful termination from her position.

Voyles is seeking compensation for all damages suffered. She is represented by Derrek W. Cummings and Larry A. Weisberg of McCarthy Weisberg Cummings PC in Harrisburg.
