Southern Polymer Inc. sues buyer over breached contract allegations

PITTSBURGH – Southern Polymer Inc. is suing a buyer over allegations that the defendant breached its contract.

Southern Polymer Inc. of Georgia filed a complaint Dec. 28 in the U.S. District Court for the Western District of Pennsylvania against Master Extrusion LLC of Alabama, claiming breach of contract and unjust enrichment.

According to the complaint, the plaintiff is a polymer and resin distributor. The defendant was a customer of the plaintiff's and allegedly purchased a large amount of a product known as "wide spec," and later claimed that it was not suitable for their needs. Master Extrusion failed to notify Southern Polymer within the time frame stated in the contract of the allegedly unsatisfactory product, the complaint states. Additionally, from July through August, the defendant made five purchases from the plaintiff, but since receiving the products has allegedly refused to pay for the items, claiming that they will not do so until the alleged dispute is settled.

Southern Polymer is seeking compensation for damages of more than $720,000. It is represented by Mary Jo-Rebelo of Houston Harbaugh PC in Pittsburgh.
