PHILADELPHIA – A man is accusing Amtrak of negligence after an accident in Philadelphia last year that allegedly left him injured.
Andrew Brenner filed a complaint on Dec. 14 in the U.S. District Court for the Eastern District of Pennsylvania against National Railroad Passenger Corp., also known as Amtrak, alleging negligence.
According to the complaint, Brenner was a passenger on train 188, which was traveling from Washington, D.C., to New York in May. According to the complaint, when approaching a curve in Philadelphia, the train maintained a velocity that was more than two times the posted speed limit. The conductor of the train allegedly failed to utilize the safety features of the train, or to reduce the speed of the train, which led to the derailment, the complaint states. Brenner was one of the allegedly injured passengers, and it is still not known if he will fully recover from the blunt trauma injuries he claims to have suffered to his head and back, the complaint states. He is suing Amtrak for negligence.
Brenner is seeking compensation for all damages received, as well as legal fees. He is represented by Daniel A. Schwarz and Daniel F. Ashton of Schwarz & Schwarz PC in Philadelphia.
