Shipping company sued after grape shipment allegedly damaged

PHILADELPHIA – A Peruvian fruit shipping company is suing a New Jersey-based shipping company over claims it damaged a shipment of grapes.

Manuelita Frutas y Hortalizas S.A.C. filed a lawsuit Jan. 12 in the U.S. District Court for the Eastern District of Pennsylvania against Compania Sud America de Vapores S.A., also known as CSAV, alleging negligence and unseaworthiness.

In December 2014 in Lima, Peru, the suit states, 1,800 boxes of grapes consigned to the plaintiff were delivered in good condition aboard the marine vessel Vittoria.

According to the complaint, the goods were then transshipped to the marine vessel Limari and were delivered by the defendant to the plaintiff, at which point the plaintiff allegedly discovered the goods were damaged, deteriorated in value, and unfit for sale or use.

The suit states the defendant was negligent in failing to provide a seaworthy vessel, failing to exercise due care in handling the cargo, and other negligent acts or omissions.

As a result, the plaintiff suffered damages of more than $39,000.

The plaintiff seeks to recover those damages, plus interests and costs of the suit. The plaintiff is represented by attorney Eugene J. Maginnis Jr. of Dugan, Brinkmann, Maginnis and Pace in Philadelphia.
