Bedford Materials allegedly violated purchase agreement for craft paper

PITTSBURGH—A Swedish company is suing a Pennsylvania materials company alleging it violated terms of a purchase agreement. 

Munksjo Paper, AB filed a lawsuit in the Western District of Pennsylvania District Court on Jan. 12 against Bedford Materials Co. Inc. for breach of contract and unjust enrichment.

According to the suit, Munksjo entered into a long-term supply agreement with Bedford on March 1, 2013 with Bedford agreeing to purchase thermally upgraded craft paper supplied by Munksjo for five years. Bedford allegedly failed to make timely payments on several invoices in 2013, which violated the terms of the agreement. Munksjo claims it agreed to work with Bedford by removing $750,000 from the accounts receivable liability and putting it into a promissory note that Bedford agreed to pay.  As of December 2015, however,  Bedford has failed to make payments on the promissory note as required by the terms of the agreement.

Munksjo is seeking judgment by the court in its favor in the amount of $2,544,154, plus interest, lost profits, attorneys’ fees and costs of the suit. Ronald H. Pollock Jr. and Kylie L. Madsen of Lancaster are representing Munksjo.
