Lowe Engineering Co. Inc. accused of age discrimination

PITTSBURGH – A Meyersdale man is suing his previous employer following his termination, alleging that it was due to his age.

Michael T. Sarver filed a complaint Jan. 28 in the U.S. District Court for the Western District of Pennsylvania against Lowe Engineering Co. Inc., alleging age discrimination.

According to the claim, the plaintiff was employed by the defendant from 2011 through 2015, and during his employment he was given performance ratings of effective or highly effective and qualified for raises. In 2014, the plaintiff was employed as an inside sales/estimator with the defendant, at which time the defendant was aware of the plaintiff's age, the suit says. In January 2015, the defendant began to hold interviews for the position which the plaintiff held at the time and on Jan. 16, 2015, Sarver was terminated due to his age, the suit states. A younger employee was allegedly hired following the plaintiff's termination.

Sarver seeks damages for lost wages, liquidated damages, attorney's fees and costs. A jury trial is demanded. The plaintiff is represented by Ronald P. Carnevali Jr. of Spence, Custer, Saylor, Wolfe & Rose LLC in Johnstown.
