City of Philadelphia pursuing sanctions in old case

PHILADELPHIA – Counsel for the City of Philadelphia is seeking financial sanctions against one of its co-defendants for not responding to interrogatory and document requests in a slip-and-fall case from more than a decade ago.

At an undetermined date, minor plaintiff Nasir Sampson (legal represented by his father Steven Sampson) allegedly suffered injuries in a fall. In response, the Sampsons filed suit against the City of Philadelphia, the Philadelphia Water Department, Philadelphia Gas Works and Sabrina Diprosperos in September 2005.

On July 31, 2006, arbitrators entered judgment of $7,500 in favor of Nasir and against Diprosperos; in favor of the City, the Water Department, the Gas Works and against Nasir; and in favor of the City, the Water Department and the Gas Works against Diprosperos on their cross-claim.

On March 4, Drew Salaman filed a praecipe to enter judgment for a principal amount of $7,500 and interest of $3,868.77 dating back from July 31, 2006, for a grand total of $11,368.77.

Further, Salaman filed a motion for sanctions on Oct. 12, seeking fines of $100.00 per day and $250.00 in counsel fees to be levied on Diprosperos, for failure to comply with requests for answers to interrogatories and documents to aid execution – which Salaman says were mailed to her via first-class mail on March 17.

A hearing in this matter was set for Thursday in Court chambers, at Philadelphia City Hall.

The plaintiff is represented by Marc F. Greenfield of Spear Greenfield & Richman, in Philadelphia.

The defendants are represented by Bernadette Betzler, Isabel C. Acevedo, and Salaman of Salaman Henry, also all in Philadelphia.
