HARRISBURG — A life insurance company is suing a policy recipient, alleging application fraud and misrepresentation.
Sagicor Life Insurance Company filed a lawsuit Feb. 2 in the U.S. District Court for the Middle District of Pennsylvania against Nicky Jensen, alleging misrepresentation and fraud.
According to the complaint, Sagicor issued a life insurance policy to Jensen on Feb. 11, 2014, with a face amount of $248,000. In 2015, the plaintiff conducted a routine investigation of its policies, revealing that personal information on the defendant’s application was allegedly fraudulent, the suit says.
The plaintiff alleges the initial policy application, which it received Feb. 7, 2014, contained materially false information pertaining to the defendant’s residency, contact details, and driver’s license. Sacigor requires policy applicants provide correct identifying information during the underwriting process.
The lawsuit states had the plaintiff known the defendant’s information was false, it would not have issued a term life insurance policy.
Sacigor seeks declarations the policy is absolutely void and that they may retain some or all of the premium paid on the policy, monetary damages, costs and attorney fees.
