PITTSBURGH — A man has filed a class-action suit against his former employer, claiming he and his colleagues were denied overtime pay.
Dwayne Herbert, on behalf of himself and others similarly situated, filed a complaint on July 7 in the U.S. District Court for the Western District of Pennsylvania against MudTech Services Inc, alleging illegal pay practices and misclassification of workers.
According to the claim, Herbert was employed as a consultant from May 2013 to May 2015. The plaintiff was classified as a independent contractor, which was a misclassification, the suit states. Additionally, the suit says that the defendant failed to pay plaintiffs the proper overtime rate for hours worked over 40 per workweek, thus violating pay standards. Herbert claims that the schedule at MudTech prevented him from pursuing other sources of income. He is suing for the allegedly illegal acts of MudTech.
