Confidential information dispute leads to court action

PHILADELPHIA — The principal employee of a consulting business is suing an Iowa company, seeking permanent injunctive relief surrounding the alleged unlawful taking of confidential information.

Needham Business Consulting PA LLC and David Fishbone filed a lawsuit on Dec. 30, 2015 in U.S. District Court for the Eastern District of Pennsylvania against Claim Doc LLC and Ben Krambeck.

According to the complaint, Needham and Fishbone developed valuable trade secrets and other intellectual properties, and made them available to Claim Doc. This included the identities of vendors to work with Needham to provide necessary services in connection with the start up and operation of its business, metrics, workflow, documents, protocols and process that were integral to Claim Doc’s business, the suit states.

The confidential information was so valuable, the lawsuit states, that the parties agreed upon compensation to Needham for providing it. Krambeck and Claim Docs allegedly did not obey the terms of the parties’ agreement and have not paid for the confidential information. Also, the suit says, the defendants cut Needham out of the business without cause or any prior notification.

The plaintiffs seek the court to enjoin the defendants from utilizing any of the confidential information, to require that the defendants destroy all the confidential information and to award the plaintiffs all legal costs and attorney fees. They will be represented by attorneys George Bochetto, John A. O’Connell and Peter R. Bryant of Bochetto & Lentz PC in Philadelphia.
