Client alleges USAA Insurance fails to pay due benefits

PHILADELPHIA — A Pennsylvania woman is suing USAA Insurance Agency, alleging refusal to compensate her for injuries sustained in an automobile accident.

Dana Zimmerman filed a lawsuit Feb. 16 in U.S. District Court for the Eastern District of Pennsylvania against USAA Insurance Agency Inc., alleging breach of contract.

According to the complaint, on June 12, 2015, Zimmerman was in an automobile accident involving two other drivers and was at the time insured by USAA Insurance. The suit says the accident was a direct result of the other drivers’ negligence, which caused the plaintiff to suffer injuries including, but not limited to, a spine fracture with unstable thoracic spine, maxillary alveolar fracture with subluxated teeth, pulmonary contusion and post-concussion syndrome.

The suit states despite Zimmerman’s demands for benefits under the policy, the defendant has refused to pay compensation under her insurance policy.

Zimmerman seeks compensatory damages of more than $150,000, together with interest, costs, attorney fees and a jury trial. She is represented by attorneys Brandon A. Swartz and Matthew E. Gallagher of Swartz Culleton, in Newton.
