Subcontractor claims contractor never paid for renovation work

PITTSBURGH – A subcontractor on three hotel projects is suing the general contractor over its alleged refusal to pay for work completed.

H Contractors LLC filed the suit March 29 in U.S. District Court for the Western District of Pennsylvania against EJH Construction Inc.

On June 29, 2015, the parties entered into a contract for the plaintiff to perform interior renovation work at three hotels.

Despite submitting invoices to the defendant for payment of the work done, the plaintiff has yet to be paid, according to the complaint.

The plaintiff brings this suit with four counts--breach of contract, recovery of compensatory interest under the Pennsylvania Contractor and Subcontractor Payment Act, and recovery of penalties and attorney fees under the CSPA.

The plaintiff seeks judgment against the defendant in an amount to be proven but which exceeds $170,000, plus interest, penalties, court costs, attorney fees and any other relief the court deems equitable. The plaintiff further seeks a trial by jury.
