Company sued over claim of not contributing to retirement fund

HARRISBURG – A company in Montoursville is being sued over a claim that it did not contribute to its employees’ union retirement and health trust fund.

Frank Kelly and Todd C. Ray, as trustees of the Plumbers and Pipefitters Local No. 520 Annuity Fund and Plumbers and Pipefitters Local No. 520 Health and Welfare Fund, filed a lawsuit March 10 in the U.S. District Court for the Middle District of Pennsylvania against Appellation Pre-Fab, L.L.C. for allegedly violating a union trust fund.

According to the claim, Appellation Pre-Fab has failed to fully pay amounts due under a trust agreement for the period of February 2012, through the present.

The trustees are seeking contributions for the months of February 2012 through the present, plus any additional liquidated damages and interest due since the filing of the lawsuit, as well reasonable attorneys’ fees.

Kelly and Ray are being represented by attorney Charles W. Johnston, P.C. of Camp Hill.
