Man sues Carlucci's Grill for age discrimination allegations

PHILADELPHIA – A former employee of Carlucci’s Grill is suing the company over claims that he was fired for being too old after 17 years of working in the restaurant.

Segundo Sanchez filed a lawsuit on April 28 in the U.S. District Court for the Eastern District of Pennsylvania against Capuano’s at Yardley Inc., doing business as Carlucci’s Grill, citing violations of the Age Discrimination in Employment Act and the Fair Labor Standards Act.


According to the complaint, Sanchez is a 61-year-old man who was employed by the defendant for approximately 17 years, working as a cook and maintenance worker. The plaintiff claims he regularly worked in excess of 40 hours per week without receiving proper overtime compensations. Sanchez reports that the defendant would only include 40 hours on his paycheck, paying the remainder in cash “under the table.”

In October 2015, the plaintiff’s manager allegedly told the plaintiff that he should take a vacation, but when he insisted he did not need one, Sanchez claims was terminated for his age without any significant performance concerns.

Sanchez seeks damages for all lost earnings and benefits, punitive and liquidated damages, costs, expenses, and a trial by jury. He is represented by Ari R. Karpf of Karpf, Karpf & Cerutti PC, in Bensalem.
