Energy management firm faces claim of not paying overtime

PITTSBURGH – A former employee has filed a class-action suit against an energy management firm for alleged failure to pay proper overtime wages.

Steven Falk filed a lawsuit Feb. 23 in the U.S. District Court for the Western District of Pennsylvania against Cinco Energy Management Group, alleging a violation of the Fair Labor Standards Act of 1938 and the Pennsylvania Minimum Wage Act.


According to the claim, from August 2013 through October 2013, Falk worked as an abstractor for Cinco Energy and was one of at least 50 abstractors who worked in excess of 40 hours per week, normally at least 60 or so hours, but were paid no overtime.

Falk is seeking an amount equal to the alleged overtime compensation due, together with liquidated damages, and reasonable attorneys' fees and costs.

Falk, who is demanding a jury trial, is being represented by attorneys John R. Linkosky and Sara E. Linkosky of John Linkosky & Associates in Carnegie, Pa.
