PHILADELPHIA — An estate representative is suing Janssen Research & Development LLC, Janssen Ortho LLC, Janssen Pharmaceuticals Inc., Bayer Healthcare Pharmaceuticals Inc., Bayer Pharma AG, Bayer Corporation, Bayer Healthcare LLC, Bayer Healthcare AG and Bayer AG, drug manufacturing companies, citing alleged manufacturing defect, failure to warn and negligent misrepresentation.
Kathie Price of Chicago, on behalf of the estate of Ramona D. Price, filed a complaint on May 13 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that they violated consumer protection laws.
According to the complaint, the plaintiff alleges that, on March 31, 2014, decedent Ramona Price began using Xarelto, and then suffered gastrointestinal bleeding and was hospitalized on May 31, 2014. The gastrointestinal bleeding caused pain and suffering, financial loss and permanent injuries, according to the suit, which also includes an allegation that the drug contributed to death. The plaintiff holds the defendants responsible because they allegedly designed, researched, manufactured, tested, advertised, promoted, marketed, distributed and sold Xarelto, failed to properly investigate, research, study and define the safety of the drug's profile, failed to adequately test it or provide adequate warnings, failed to disclose the need for dose adjustments and failed to provide adequate instructions on using Xarelto.
The plaintiff requests a trial by jury and seeks compensation for all damages, costs, interest and fees, including attorneys' fees, to which she is entitled and such other relief as the court deems appropriate.
