Woman says employer violated overtime wage law

HARRISBURG — A woman has filed a class-action lawsuit against SMG Group LLC, an employer, claiming that as a store manager she was not properly paid for overtime, in violation of the Fair Labor Standards Act.

Jenny Shiptoski filed a complaint on June 20 in the U.S. District Court for the Middle District of Pennsylvania against SMG Group LLC, alleging that the employer failed to fairly compensate store managers for all hours worked.

According to the complaint, the plaintiff alleges that she regularly worked 50- to 70-hour weeks but was not paid overtime wages for hours worked in excess of 40 per week, and she holds SMG Group LLC responsible for that alleged violation of the FLSA.

The plaintiff requests a trial by jury and seeks unpaid overtime wages including interest, liquidated damages, court costs and any further relief the court grants. She is represented by Mark J. Gottesfeld, Peter Winebrake, and R. Andrew Santillo of Winebrake & Santillo, LLC in Dresher.
