Couple's suit says vehicle maker, sellers at fault for injuries

PITTSBURGH — A couple's lawsuit against all-terrain-vehicle maker Polaris Industries Inc. and ABC Sellers/ Lessors/ Authorized Dealers (fictitious defendants 1-10), alleged negligence, design defect and insufficient measures taken to prevent injuries.

John Barry and Sandra Barry filed a complaint on June 21 in the U.S. District Court for the Western District of Pennsylvania against the defendants, alleging that they failed to provide notice or warnings to consumers who purchased their vehicle prior to an alteration of design.

According to the complaint, the plaintiffs allege that on Aug. 7, 2014, John Barry sustained severe physical injuries including the severing of his foot as a result of partially falling out of a vehicle. The plaintiffs hold the defendants responsible because they allegedly failed to provide adequate notices to consumers, including the plaintiffs, who had already bought the vehicle prior to its design being altered with better safety features.

The plaintiffs request a trial by jury and seek compensatory damages plus interest, court costs and any further relief the court grants. They are represented by Marc P. Weingarten and Michael B. Leh of Locks Law Firm in Philadelphia.
