Pair sue motorist over crash through window

HARRISBURG — A couple's lawsuit against motorist Cynthia Wilen alleges negligence and insufficient measures taken to prevent injuries when her vehicle smashed through the window of a Burger King.

Bonnie Fader and Michael Fader filed a complaint on June 28 in the U.S. District Court for the Middle District of Pennsylvania against Wilen, alleging that the motorist failed to properly control her vehicle, causing injuries to the plaintiffs.

According to the complaint, the plaintiffs allege that on Oct. 3, 2014, they sustained physical injuries when Wilen's vehicle suddenly crashed through the glass window of a Burger King where they and their immediate family were eating. The plaintiffs hold Wilen responsible because the defendant allegedly failed to apply the brakes of her vehicle, causing it to crash through the glass window of Burger King.

The plaintiffs seek judgment against the defendant in an amount in excess of $75,000 plus interest, delay damages, court costs and any further relief the court grants. They are represented by Jon Ostroff, David B. Kline and Eric M. Frost of Ostroff Injury Law, P.C. in Plymouth Meeting.
